The State Customs Committee pointed out an error that should not be made when declaring imported vehicles for personal use, as it may serve as grounds for understating the amount of payments, which, accordingly, will entail unpleasant consequences.
We are talking about information about the date of manufacture and engine capacity of the car.
— Often, the declarant indicates such data based on the information in the certificate of registration of the foreign state of the vehicle. For example, the “date of issue” column of such a document indicates the date of issue not of a specific vehicle, but of a model range of cars or the date of its commissioning, and the information on the engine displacement contains inaccuracies (for example, the volume is indicated as 1.5 instead of 1507, or 1500 instead of 1507), – explained the State Customs Committee.
Why is this important? Due to the incorrect declaration of this information in the declaration, an incorrect duty rate is applied. Accordingly, this is reflected in the amount of customs duties payable.
In cases of submission of inaccurate information, which served as the basis for underestimation of the amount of payments due, the declarant’s actions are considered to be indicative of an offense under Part 4 of Article 15.5 of the Code of Administrative Offenses (“Failure to declare or submission of inaccurate information about goods”). The penalty provides for a fine in the amount of ten to thirty percent of the value of the subject of the administrative offense, that is, the value of the vehicle.
— To avoid such situations, we recommend clarifying the information that affects the calculation of customs duties in advance, — noted the State Customs Committee. — We remind you that the declaration is carried out by the declarant or the customs representative acting on behalf and at the direction of the declarant. Submission of the declaration must be accompanied by the presentation to customs of documents confirming the purchase of the vehicle, as well as those necessary for calculating customs duties (technical passport, purchase and sale agreement, gift agreement, etc.).
